Court Up Held Judiciary Council Decision – Rick Boucher is suspended for 3 years

The Honourable Justice M.A. Binder released the decision in relation to Rick Boucher and the decision of the Métis Judiciary Council.

Rick Boucher appealed the decision of his suspension based on the following issues:

  1. Is the Métis Judiciary Council a public or private body?
  2. What is the appropriate scope and standard of review?
  3. Is there a reasonable apprehension of bias?
  4. Was the Métis Judiciary Council properly constituted?
  5. Did the Métis Judiciary Council act reasonably in refusing the adjournment request on November 25, 2007? And
  6. Is the substance of the decision subject to review, and if so does it meet the appropriate standard?

In spite of the fact that in February Trevor Gladue reported in Métis Matters that “…Métis Nation of Alberta (MNA) Member Mr. Rick Boucher vindicated in the Court. The Court ordered the Métis Judiciary Council (MJC) decision be stayed concerning Mr. Boucher's membership after evidence was presented that MNA President Audrey Poitras and the MJC Chair had ignored the principles of procedural fairness and rules of natural justice.

Justice Binder upheld the decision and dismissed Rick Boucher’s appeal. No vindication...

We will submit more details on this news as they become available but in all elements of the above appeal – the Judge ruled in favor of the Judiciary Council and the principles and institutions that Métis people in Alberta set up in their quest for accountable elected leaders and organizations.

This fiasco brokered by Trevor, has landed Mr Boucher directly where he deserves to be. A person with absolutely no understanding of the MNA bylaws, or the Provincial Council, or executive committee procedure, may have made an "error". This, however was not an error but an intentional undermining of the Council's process. The agreement between Mr Boucher, and MNC was already inked, while in the background Mr Gladue was scrambing to pull in support of other Council members in order to "fax" a motion in support to the President. The splits over this issue started at Provincial Council level, and have spread throughout the Nation. Its definately taken some time, and President Poitras observed the protocal of not discussing details at the Assembly, or anywhere for that matter, while in the meantime Mr Gladue, has utilized all his resources, churning out Bogus press releases, disguised as official documents, including APTN to present his position, and support of the actions of Mr Boucher and the Metco agreement. I hope President Poitras and the Metis Nation of ALberta do a press release on APTN! I hope Rick and the others finally realize that they have been manipulated for Mr Gladue's political purposes.
Through all of this, President Poitras, has demonstrated courage to maintain her position, her accountability and the transparency of "the elected leaders" has been questioned, and all the while, the issue has been first, before the Judiciary Council, then the Court of Queen's Bench. You are to be commended, President Poitras, for continuing to stand up for Truth.

Its about time one of these Gladue followers are held accountable for their actions. MMF hope your taking note you could be next.

Its nice to see MNA holding their elected board accountable. It was even nicer to see the courts agreeing with your ruling. If only we could get that level of justice in Manitoba.
